Idaho appellate court says no to robbery appeal

The Idaho Court of Appeals says a man who pleaded guilty to robbing a bank in north-central Idaho doesn't have the right to appeal his sentence.

David L. Payton was sentenced in January to at least eight years and up to life in prison for robbing a Lewiston bank. He pleaded guilty to two counts in connection with the robbery, and in exchange, prosecutors dropped three additional counts.

Payton appealed, contending the sentence was excessive. The Lewiston Tribune reports that on Friday, the appellate court turned down that appeal.

The three appellate judges found that Payton waived his right to challenge his sentence when he made the plea agreement.

Teen who died in jail hanged himself

The Spokane Medical Examiner's Office has confirmed a Coeur d'Alene teen who died while in custody in the Nez Perce County Jail hanged himself.

Chad Gardner, 19, was arrested and taken into custody at the jail on a Kootenai County probation violation. He was being held in a single occupant cell when jail officers found him unconscious in his cell.

No foul play is suspected.

Clarkston man pleads guilty in vehicular homicide case

A 20-year-old Clarkston man pleaded guilty Thursday in connection with a fatal wreck west of Clarkston in July that claimed the life of a Lewiston girl.

As part of a plea agreement, Gilberto Alex Garcia pleaded guilty to vehicular�homicide and vehicular assault.

Garcia was driving a 2002 Chevy pickup on Mail Route Road west of Silcott Wye Road at about 10:40 p.m. on July 21 when it rolled, ejecting 16-year-old Ashley Nelson. She died at the scene. Another 17-year-old girl was also injured in the crash.

Several people addressed the court, including Nelson's father, Doug Nelson, who held up a picture of his daughter and told Garcia that he has "taken something so precious from our whole family."

Garcia told the court that he wants "to take full responsibility for my actions," which Asotin County Superior Court Judge William Acey said he respected.





Acey sentenced Garcia to the state recommendation of 26 months in prison for count one and 12 months in prison for count two. He also ordered Garcia to have 18 months of supervision upon his release from prison.

Authorities ID man who died in N. Idaho jail

A northern Idaho man who died while an inmate at the Nez Perce County Detention Center in Lewiston has been identified as Chad Vincent Gardner, 19, of Coeur d'Alene.

Idaho State Police Sgt. Vernon Grotjohn said an autopsy was conducted Monday with the preliminary autopsy report possibly ready by Thursday.

Authorities said Gardner was found alone in his cell Saturday morning just after midnight by a deputy doing routine cell checks.

Deputies and medical responders attempted first-aid but Gardner was declared dead at the scene.

The Idaho State Police Critical Incident Team is investigating the death.

Teen arrested for allegedly raping Lewiston girl

A 14-year-old Clarkston boy was taken into custody Saturday for allegedly raping a 5-year-old Lewiston girl.

The Asotin County Prosecutor's Office says charges will be filed either later on Monday or Tuesday.

The boy is being held at Martin Hall juvenile center in Medical Lake. His next court appearance is scheduled for November 19.

Coeur d'Alene teen dies in custody in Lewiston

A 19-year-old Coeur d'Alene man died early Saturday morning after he was found unconscious in his cell at the Nez Perce County Detention Center just after midnight.

The Idaho State Police has identified the man as Chad Vincent Gardner.

According to a news release, an autopsy is taking place Monday in Spokane under the direction of Nez Perce County Coroner Gary Gilliam.

The Idaho State Police Critical Incident Team has been called in to investigate Gardner's death.

Firefighters find body in burning car

Authorities in northern Idaho say firefighters putting out a burning vehicle found a body inside.

The Latah County Sheriff's Office said evidence indicates the vehicle drove straight off the road, accelerated through a farm field, jumped a creek and crashed into the bank on the other side where it caught fire.
